Individuals And Sole Proprietorship:
  1. Copy of the logo, in case of trade mark for word, logo is not required.
  2. General Power of Attorney on stamp paper is an authorization from the applicant to a Trademark Agent / Attorney for filing the trademark application on his/her behalf.
  3. ID Proof of the individual or Proprietor.
  4. Address Proof of the individual or Proprietor.
  5. User affidavit on stamp paper is trademark is in use before application
Partnership/LLP/Company/Small Enterprise /Startups/Others:
  1. Copy of Logo, in case of trade mark for word, logo is not required.
  2. Power of Attorney on the stamp paper.
  3. Incorporation Certificate or Partnership Deed.
  4. ID Proof of the Signatory.
  5. Address proof of the Signatory
  6. User affidavit on stamp paper is trademark is in use before application

Trademark Registration Process

There are 4 steps in trademark registration.

Step 1: Trademark Search

The first step is Trademark search. This process is all about checking the availability of trademark. In case similar marks are found, check the description to see if the mark represents the same set of goods or services proposed by you.

Step 2: Application Preparation

An application for registration is prepared in Form TM-A .

Step 3: Application Filing

The application can be filed through both online and offline mode

Offline:In case, if you opt for offline mode, then fill the application and physically hand it over to the registrar of the trademark office.
It will take around 15-20 days to receive the acknowledgment receipt.

Online: if you apply through online mode, you will receive the acknowledgment receipt after 1 hour afterwards you are eligible to use the trademark(™) along with the brand name.

Step 4: Government Processing

Once a trade mark application is filed and the Government process the application, the status of the trade mark application must be checked periodically. In case of objection, an objection reply must be submitted by the applicant within 30 days. Similarly, in case of opposition, the applicant must respond in a time-bound manner to allay the concerns of the counter-party.
